TOWN BOARD MEETING
September 16, 2009

Chairperson Platteter called the meeting to order at the Milton Town Hall at 7:30 p.m. with all board members present. Also present were 6 community members.

Informal Public Comment:

• Mississippi Thunder Speedway: Scott Bagniewski and Ned Crowley commented on recent activity at the racetrack. For the past several weeks there have been cars practicing at the racetrack on Wednesday and Thursday nights and Saturday mornings, many times without the owner present. Clerk Engel read the minutes of the March 2009 meeting at which Mr. Timm stated that such practices would not be occurring. Mr. Crowley pointed out that he was not concerned about the Friday night racing, even though the races have been running later than Mr. Timm stated they would. Chairperson Platteter will contact Mr. Timm to remind him of the promises he made at the March 2009 meeting.

• Badger Road: Ned Crowley noted that there was some breakup occurring on Badger Road near the end of his driveway. Paul Duellman will investigate and patch if necessary.

Bills: Bills were presented. Motion to pay remaining bills by Supervisor Bagniewski, Jr.; seconded by Supervisor Dienger (motion passed).

Approval of Minutes: Clerk Engel had posted on the website in advance the minutes from the August 19, 2009 monthly meeting prior to the meeting. Supervisor Dienger moved to approve the minutes and Supervisor Bagniewski seconded the motion (motion passed).

Other Business:

• Neighborhood Electric Vehicles: Clerk Engel requested from Jim Thompson the statutory authority for the NEV ordinance requested by the State Park System. She had not heard back from him at the time of the meeting so the issue was tabled and will be placed back on the agenda at the request of Mr. Thompson.
• Town Hall Floor Issues: Rusty Gibbons is going to start tearing the chimney out tomorrow, after which he will give an estimate on the floor and cement slab.
• Fire Protection Ordinance: Chairperson Platteter reported that the Fountain City Fire department is not going to do any billing to individuals for fire calls. The City of Fountain City and Town of Buffalo plan to do their own billings. Chairperson Platteter proposes that we amend the ordinance to modify the rates as follows: to have a per call rate consistent with the established Buffalo County Fire Association rate and to have a per man hour rate consistent with the established Fountain City Fire Association rate. Supervisor Dienger made a motion to amend the ordinance accordingly. Supervisor Bagniewski seconded the motion (motion passed). Clerk Engel will start a rate schedule so that ordinances don’t need to be amended every time a rate changes. Kenneth Haeuser noted that the Fountain City Fire Association bylaws may need to be changed to allow for direct billing by the municipalities.

• Repeal/Amendment of Ordinance #4 – Regulate and Control Public Function: Supervisor Dienger made a motion to repeal the ordinance as it was obsolete. Supervisor Bagniewski seconded the motion (motion passed). Next month the Board will review Ordinances 5, 6 and 8.

• Roads:

o Crack Filling: Allied did the crack filling but missed a section on Park Road—they will be coming back to complete the repairs.

o Lovers Lane Closure: Chairperson Platteter met with Attorney Chambers and received a copy of the statutory language that must be followed in transferring the road (Wis. Stat. Sec. 82.10). Chairperson Platteter has already spoken to some of the parties that need to be notified (DNR, Land Conservation, Department of Transporation, Robert Cisewski). Chairperson Platteter will meet with Attorney Chambers Chambers next week to follow-up. This matter needs to be on next month’s agenda and properly noticed.

o Badger Road: The zoning office has requested that the township come up with a name for the section of Badger Road on which Bruce Malotke currently lives. According to the state, this road is Cedar Road. Supervisor Dienger made a motion to name it Hickory Street and Supervisor Bagniewski seconded the motion (motion passed).

o TRIP Application: The TRIP application has not yet been received. Next year a section of Waumandee Creek Road will need to be re-done at an estimated cost of approximately $100,000.

o Schlawin Dugway: Paul Duellman asked for and received permission to obtain blacktop from Whitehall because it is $20/ton cheaper.

o Weeds: Paul Duellman was instructed to cut weeds along the roads.

Adjournment: Motion to adjourn by Supervisor Dienger and seconded by Supervisor Bagniewski. (motion passed).
