November 19, 2008 Monthly Meeting
TOWN OF MILTON
TOWN BOARD MEETING
November 19, 2008
Chairperson Haeuser called the meeting to order at the Milton Town Hall at 7:30 p.m. with all board members present except Sandra Isakson. Also present were nine community members.
Bills: Bills were presented. Motion to pay remaining bills by Supervisor Bagniewski and a second by Supervisor Platteter. (motion passed).
Approval of Minutes: Clerk Engel had distributed the minutes from the October 15, 2008 monthly meeting prior to the meeting. Supervisor Platteter moved to approve the minutes and Supervisor Bagniewski seconded the motion (motion passed).
Approval of Budget: Supervisor Bagniewski moved to approve the 2009 budget. Supervisor Platteter seconded the motion (motion passed).
Town Hall Repairs: The floor underneath the heating unit at the Town Hall is sinking and the chimney appears to be settling. The consensus was that we needed to get someone to look at the issue and determine what repairs needed to be done. Chairperson Haeuswer will contact Rusty Gibbons to look at the problem. If any electors knows of someone else who would be qualified to examine the problem, he/she should contact Chairperson Haeuser immediately.
Tri-Oval Speedway Noise: Chairperson Haeuser attended the racetrack meeting with the new “owner” (Bob Timm) last night in Winona. Only three racetrack neighbors were present and none of them asked any questions. Bob Timm seemed very genuine in his concern for keeping the neighbor’s interests in mind. Timm plans to have three Saturday practice sessions during the seasons and will provide notice to the neighbors of those dates. Regular races will start at 6:00 p.m. with Hornets and end by 10:30 p.m. Timm is in the process of making changes to the racetrack itself, including added a buffer strip for noise, and is doing his own excavating work. Apparently he was out working at 6:00 a.m. one recent Sunday morning, which did not sit well with neighbors. He plans to meet with the neighbors next spring prior to the start of the race track. The consensus at the meeting was that everyone hopes that he will be true to his word and work with the neighbors.
Road Maintenance: Tricia Justin wondered when the cracks would be sealed on the roads near her. Chairperson Haeuser stated that the Allied Blacktop representative promised him that work would begin on Monday, but it did not. Chairperson Haeuser further noted that the person who he normally dealt with was no longer at Allied, so that was suspicious. However, Supervisor Bagniewski did spot an Allied truck in Alma so he feels they will be coming shortly.
Snowplowing: Tricia Justin was wondering how the plower was hired, what are the expectations and how is the work evaluated? Chairperson Haeuser stated that we have a 10 year contract with Louis at a locked-in rate. Ms. Justin is concerned about the sod being cut up. Discussion was had on how best to avoid this and the consensus was that she should by some reflective pencil thin sticks/posts to mark the end of her lawn. Bob Platteter and Janie Baures have done this on their lawns and have had good results. Supervisor Platteter noted that snowplowing and grass cutting is not an exact science. Paul Duellman was complimented on how he swept up the sand following the winter season last year.
Cedar Road: A dispute has arisen with respect to Cedar Road between David Duellman and Fred Krueger. Apparently, Cedar Road (a town road) goes straight back to property that used to be owned by Bechly (past Bruce Malotke’s property). The road apparently ends at the edge of the Bechly property, which has since been split into two parcels—one purchased by David Duellman and one purchased by Fred Krueger. The issue is whether the town road provides access to both parcels or just one, with the other being land-locked. David Duellman also wants to sell lots on his parcel and was told by Supervisor Bagniewski that if he did so, he would have to provide a blacktopped road for access to those lots. The consensus was that this issue was one between Duellman, Krueger, Bechly and Malotke. The other issue was that Bruce Malotke’s fence was too close to the road, which is not an improved road. Kenny stated that if we made people move fence off the road right of way, people would be re-fencing all over.
Review of Ordinances: Clerk Engel reported that the repeal/revision of existing ordinances would require examining the statute (if any) under which the ordinances were enacted to determine whether the enacting statute required any special way to repeal/revise the statute and would require specific notice in the Agenda. She suggested that something like this should be handled in parts or by committee, rather than tackling all of them at a board meeting. Supervisor Platteter suggested that the Board look at one ordinance each meeting to see whether that ordinance should be revised/repealed and that was an acceptable to the Board.
Adjournment: Motion to adjourn by Supervisor Platteter and seconded by Chairperson Haeuser . (motion passed).
