TOWN BOARD MEETING
March 18, 2009

Chairperson Haeuser called the meeting to order at the Milton Town Hall at 7:30 p.m. with all board members present. Also present were 12 community members and Robert Timm (Winona) on behalf of Mississippi Thundery Speedway.

Bills: Bills were presented. Motion to pay remaining bills by Supervisor Platteter; seconded by Eugene Bagniewski (motion passed).

Approval of Minutes: Clerk Engel had posted on the website the minutes from the February 18, 2009 monthly meeting prior to the meeting. Supervisor Bagniewski moved to approve the minutes and Supervisor Platteter seconded the motion (motion passed).

Mississippi Thunder Racetrack: Bob Timm gave update on Mississippi Thunder Speedway. Races are scheduled to start on April 17, 2009 and his plan is to allow some practice time a few weeks before the first race, but not throughout the season and definitely not whenever the racers feel like practicing. The races will stay on Friday nights and the start time will be moved up ½ hour, in the hopes that they will end by 10:30 p.m. Other modifications are being made (radios in cars, new lineup board, yellow flag limitations) to speed up the races. Many modifications are being made to the track and Mr. Timm asks that the neighbors be patient while these projects are being completed. To alleviate some of the dust concerns, he purchased a terrigator (water applier). He would like people to call him with any concerns and left business cars with several phone numbers for him as well as his e-mail address. Right now, he plans to have special races on Memorial Day (starting at about 6:00 p.m.); July 2nd/3rd; and the Pumpkin Race in October. He is sensitive to the problems that people had with the former owner and plans to run things differently.

Road Maintenance and Snowplowing: Chairperson Haeuser gave an update on the gas tax credit from the State. We did not get full credit for the Fern Circle road because it is not completed. The head of the Department of Transportation drove through Lover’s Lane and he said it wasn’t plowed and if is not plowed we will not get gas tax credit for it. Chairperson Haeuser stated that the new board will have address the situation with respect to Lover’s Lane, since the bad condition of the bridge will cause problems in keeping the roadway open and plowed.

Fire Protection Ordinance: Robert Platteter will talk to the Fire Department about revising Ordinance #3 insofar as what the Fire Department would like to see (or needs to have) in the Ordinance. The issue of acting on Ordinance #3 was tabled until next meeting.

Mississippi Thunder Beer License: Clerk Engel reported that all the proper documentation was submitted by Mississippi Thunder for its beer license. Supervisor Bagniewski made a motion to grant the license and Supervisor Platteter seconded the motion. (motion passed)

Update on C-FC FFA Town Hall Renovation Project: Clerk Engel reported that C-FC FFA has agreed to do the Town Hall renovation project as their spring community service project. Clerk Engel will coordinate the scheduling of the project.

Announcements and Discussions:

• Garbage Update: The garbage dumpster is working well from the Town’s perspective; however, Snapper (Duane Hund) has an issue with the tipping fee. For one month, Snapper received $42.00 in tipping fees, which is a lot of effort in opening/closing the dumpster for little remuneration. Snapper feels that approximately $200 per month would be an appropriate amount. Some options for resolution include restricted hours (Saturday mornings); charging per bag; increasing the per tip fee; eliminating the service and possibly others. This issue will be put on next month’s agenda.
• Annual Meeting: The Annual Meeting will be held on Wednesday, April 15, 2009 at 7:00 p.m., immediately before the April Town Board Meeting.
• Update on Dog and Livestock Ordinance: The Buffalo County Board is considering a new ordinance which provides restrictions on, among other things, unconfined and loud animals. The ordinance is not restricted to just dogs, but includes such things as sheep, fowl, rabbits and others. Fines for violations of the ordinance are $250 for the first violation and $500 for the second violation. The Sheriff’s Department will be enforcing the ordinance. The Town of Milton does have a dog ordinance which is not as comprehensive as the one proposed by Buffalo County.

Public Comment: Scott Bagniewski expressed concern about the number of junked vehicles located at some town resident’s homes. He would like to know whether there is an ordinance on junked vehicles in the township. There is not. Chairperson Haeuser cautioned that enacting an ordinance would have unintended consequences and that it could not necessarily be applied differently to different people (i.e. a farmer with a piece of farm equipment in his field versus a person with a disabled vehicle in his driveway).
