TOWN OF MILTON

TOWN BOARD MEETING
June 18, 2008

Chairperson Haeuser called the meeting to order at the Milton Town Hall at 7:30 p.m. with all board members present. Also present were eight community members.

Resignation/Appointment of Supervisor: Rodney Bagniewski had submitted his resignation and supervisor. Ken Haeuser nominated Robert (Bob) Platteter to fill the vacant supervisor seat. No one else expressed an interest in serving as supervisor. Platteter was appointed to the supervisor spot by unanimous agreement of the voting members (Chairperson Haeuser, Clerk Engel and Supervisor Eugene Bagniewski, Jr.). Platteter signed the oath of office and will serve out the remainder of the term (April of 2009).

Bills: Bills were presented. Motion to pay bills by Supervisor Platteter with a second by Supervisor Eugene Bagniewski, Jr. (motion passed).

Approval of Minutes: Clerk Engel had distributed the minutes from the May 15, 2008 monthly meeting prior to the meeting. Supervisor Platteter reviewed them on Clerk Engel’s computer. Supervisor Bagniewski moved to approve the minutes and Supervisor Platteter seconded the motion (motion passed).

Alcohol Licenses: Clerk Engel reported that she received timely and complete applications (including valid seller’s permits) for alcohol license from Drift Inn (Jo Borchert) and Bay’s End (Steve Altobell). Supervisor Bagniewski moved to issue alcohol licenses to both and Supervisor Platteter seconded the motion (motion passed).

Clerk Engel also reported that she had received late applications from Lance Wilson (who is applying for a conditional license as he has in years’ past) and Jeff Duellman. Lance Wilson’s application will be acted upon at the July meeting, as he is not currently selling alcohol/beer. However, Jeff Duellman is currently operating Tri-Oval and, unless the board calls a special meeting upon proper notice during the month of June, Mr. Duellman’s license will expire and he will be operating without a license until the July meeting. Clerk Engel detailed the efforts she had made this year, as well as in years past, to secure Jeff Duellman’s compliance with the alcohol licensing regulations. She also reported that the Wisconsin Towns Association had advised the Board that it need not hold a special meeting to address the liquor license issue, but that it could do so. If so, it would be appropriate to assess the additional costs of such a meeting to Mr. Duellman. Chairperson Haeuser initially made a motion to not hold a special meeting. However, after discussion, he withdrew his motion. Supervisor Bagniewski then made a motion to offer a special meeting to Mr. Duellman upon the following conditions (1) he must request it in writing; (2) the request must be given to Sandy Isakson at the Waumandee State Bank no later than June 23, 2008 at 9:00 a.m. (so it can be published); (3) he must pay the additional costs of publication and (4) there will be no future extensions on any applications by him for licenses. Supervisor Platteter seconded the motion (motion passed). Clerk Engel will write a letter to Mr. Duellman outlining the condition. Louis Duellman also indicated that he would be speaking with Jeff Duellman regarding the issue.

Roadwork/Zoning:
• Chairperson Haeuser reported that the County is changing the names of the sideroads in the county, which only affects three roads in our township. Those people on the affected roads will be getting different addresses.
• Clerk Engel read the letter that she had received from Buffalo County Zoning regarding Jeff Duellman’s request to have the zoning ordinance changed to allow for a mobile home park as a conditional use of an ag district. A meeting on the matter is scheduled for July 3, 2008 at Alma.
• Chairperson Haeuser reported that the issue with Rich Ernst’s subdivision has been resolved and Mr. Ernst will have to make a pass out lane to comply with the state’s requirements. The town will not be able to accept the road until approved by the State.
• Chairperson Haeuser reported that he has heard nothing on the Lutheran Home issue. He did note that Warren Bechly stated that if the road was located in another area, he would not go along with that and the matter could still fall to our jurisdiction to condemn the land.
• An issue was raised as to whether the Town should install guardrails on Hoch’s Road Bridge. Discussion was had on the issue and Paul Duellman agreed to see what could be done with respect to guardrails and report back to Chairperson Haeuser.

Garbage Issue: Chairperson Haeuser had Clerk Engel read a letter the Town recently received from Waste Management. Waste Management decided that it would no longer sell bags in the township and that it would be more than doubling the cost of the dumpster—but would not require the items placed in that container to be in a Waste Management bag. Apparently, the cause of this was that people were disposing of garbage in the dumpster without placing them in the Waste Management bags (as was required). Chairperson Haueser reported that the Cyrus garbage operation could offer us a dumpster for significantly less, but that he was unsure as to whether Cyrus could provide curbside pickup (as is presently being done in some areas of the Town) or whether Waste Management would continue curbside pickup if we did not continue to use its dumpster. Much discussion was had on the issue and the issue was table until next meeting to allow Chairperson Haeuser to do some further checking. Notice on this issue will be included in next month’s agenda.

Adjournment: Motion to adjourn by Supervisor Platteter and seconded by Supervisor Eugene Bagniewski, Jr. (motion passed).
