TOWN OF MILTON
TOWN BOARD MEETING
June 17, 2009
Chairperson Platteter called the meeting to order at the Milton Town Hall at 7:30 p.m. with all board members present. Also present were 4 community members.
Informal Public Comment:: None.
Bills: Bills were presented. Motion to pay remaining bills by Supervisor Bagniewski, Jr.; seconded by Supervisor Dienger (motion passed).
Approval of Minutes: Clerk Engel had posted on the website in advance the minutes from the May 20, 2009 monthly meeting prior to the meeting. Supervisor Dienger moved to approve the minutes and Supervisor Bagniewski seconded the motion (motion passed).
Other Business:
• Liquor License Applications: Clerk Engel reported that all current alcohol licenses holders submitted sufficient applications and passed background checks. Eugene Bagniewski, Jr. made a motion to grant licenses to Jo Borchert (Drift Inn); Steve Altobell (Bay’s End) and Mississippi Thunder Speedway (Robert Timm). Supervisor Dienger seconded the motion (motion passed). Eugene Bagniewski, Jr. also made a motion to grant a conditional license to Lance Wilson on the condition that he must obtain a valid seller’s permit before being issued an unconditional license. Supervisor Dienger seconded the motion (motion passed).
• Town Hall Furnace/Floor: Bids from Schaffners for the replacement or move of the old furnace were reviewed; the bid for a new garage type furnace was $50 more than the bid to move the old furnace; however, that bid included the removal of the old furnace. Duane Hund offered to purchase the old furnace and tank with fuel and to remove it from the premises. Supervisor Dienger moved to sell the old furnace and tank with fuel to Duane Hund for $50, provided he removed them from the Town Hall. Eugene Bagniewski, Jr. seconded the motion. On a motion by Supervisor Dienger and a second by Eugene Bagniewski, Sr., the Board elected to purchase a new furnace from Schaffner’s with the understanding that there would be some discount due to the fact that Schaffners would not have to remove the furnace and tank.
• Crackfill: The Board reviewed and discussed bids by Scott and Allied for the crackfilling job in the Township. Eugene Bagniewski, Jr. moved to award the bid to Allied Blacktop for the bid price of $15,583.00; Supervisor Dienger seconded the motion (motion passed).
• Lovers Lane: Supervisor Platteter was not able to contact Robert Cisewski about his desire to assume responsibility/ownership of Lover’s Lane, but will see him this weekend. Kenny Haeuser stated that the road is a disaster, noting that if you close the road and leave it as is, it would cost $20,000 to remove the bridges. On the other hand, if the road was made into a walking trail, it would create liability problems for personal injuries. He feels that if Mr. Cisewski would be willing to take the road back, the decision is obvious. He further notes that, in the past, notice had to be given to adjoining landowners of an intent to close the road; however, he feels that might have changed. Supervisor Dienger feels that the most prudent course of action would be to engage legal counsel to research what steps need to be taken to close the road. Supervisor Dienger moved to contact Attorney Michael Chambers to explore the legal aspects of closing Lover’s Lane Road—either giving it back or closing it as a town; Supervisor Bagniewski seconded the motion (motion passed).
• Ordinance #3: Chairperson Platteter read his proposed changes to Ordinance #3, which eliminated the actual rates for fire service, instead referencing the Fire Association rates. He also felt that a provision should be added to allow the Town to bill residents of the Township who intentionally start a fire and then require the fire department to respond (such as if the fire was lit during a time when it should not have been lit and gets out of control). Clerk Engel suggested that the proposed ordinance be presented to the Wisconsin Towns Association for review and the Board agreed.
Adjournment: Motion to adjourn by Supervisor Dienger and seconded by Supervisor Bagniewski. (motion passed).
