TOWN BOARD MEETING
July 15, 2009

Chairperson Platteter called the meeting to order at the Milton Town Hall at 7:30 p.m. with all board members present. Also present were 5 community members.

Informal Public Comment:: Gerald Goran wants to know what is going on with the Steve Singer property in the Park Annex. Chairperson Platteter and Gerald Goran will go over and talk to Mr. Singer. They also want to know what is going on with the Park Street Crossing because the railroad tore the crossing out and has gravel there. Paul Duellman will check with the road manager of the railroad, Mike Vietz and find out the status. Paul Duellman reported that they are going to be replacing the steel in August/September so the road will probably remain torn up.

Bills: Bills were presented. Clerk Engel and Treasurer Baures explained the Waste Management bill. Motion to pay remaining bills by Supervisor Bagniewski, Jr.; seconded by Supervisor Dienger (motion passed).

Approval of Minutes: Clerk Engel had posted on the website in advance the minutes from the June 17, 2009 monthly meeting prior to the meeting. Supervisor Dienger moved to approve the minutes and Supervisor Bagniewski seconded the motion (motion passed).

Other Business:

• Town Hall Furnace/Floor: The furnace is gone. Rusty Gibbons was going to tear the chimney out and repair the roof. Supervisor Dienger asked if Eric Hofer if he would be interested in giving a bid on that; he had no problem with getting Rusty Gibbons in to get rid of the chimney, fix the floor and the roof at $25/hour. No new bid for the furnace has been received from Schaffner’s.

• Fire Protection Ordinance: Clerk Engel distributed a list of the last 5 years of expenses for fire protection. The Town of Milton currently pays ¼ of the cost for the Volunteer Fire Dept. The Town is also billed for any fire run in the township and that is charged by the man hour. Milton would not pay for mutual aid. The ¼ cost plus fire runs totals between $9,500 and $11,500 or so per year. There are also payments received from the state, called 2% dues, which are passed directly through to the Fire Department and which are around $1,300/year. Therefore, the amount that we would be talking about in trying to collect in fire service payment is $1,000 to $2,000 per year. Three other Townships funding the Fountain City Fire Department: Cross, Buffalo and City of Fountain City. Town of Buffalo is working on getting a Fire Protection Ordinance; Town of Cross does not have one. Town of Fountain City has one but they also have a burn permit. The Wisconsin Towns Association lawyer stated that a Fire Protection Ordinance could allow us to bill for intentional fires and not bill for accidental fires, but we would probably be opening ourselves up to litigation if we did so. Clerk Engel noted that the Town had not billed anyone for fire runs for the last several years. Chairperson Platteter stated that the Fire Department did bill for some fires, but wasn’t sure how that was determined. Clerk Engel will talk to Paul Schaffner of the Fire Department about what billings are being used/pursued on fire calls. The issue will be tabled for now.

• Lovers Lane: Chairperson Platteter talked to Robert Cisewski and he’s more than willing to take the road back but does not want to end up with liability. Supervisor Platteter stated that it would be his responsibility to block the roadway to prevent access. For Mike Chambers to get started we would need a legal description of the roadway; and he would draft the paperwork. Clerk Engel will review her records to see if we have a description; otherwise Chairperson Platteter will obtain one from the Courthouse. Eugene Bagniewski, Jr. moved to have Chambers draw up the paperwork and start the process to get the town road dedicated.

• Other Roads: Supervisor Dienger and Chairperson Platteter went and talked to Fred Krueger and Bruce Malotke. Mr. Malotke agreed to move his fence (which was on Township right-of-way).. Chairperson Platteter told Fred Krueger that the road was in the correct position and would not be blacktopped. Paul Duellman reported that there are some road issues on Waumandee Creek Road and Canada Ridge Road and Schlawin’s Dugway. Board members will go out and take a look at the roadways and let Paul Duellman know what they think. Crackfilling will occur in early August.
